Indemnity Declaration
1.
You hereby authorize Transauto Recruitment cc and its duly
authorized verification agent, Kroll MIE (Pty) Ltd, to forward your
fingerprints, and any other personal information, to verification
information suppliers acting on behalf of Transauto Recruitment cc and
Kroll MIE (Pty) Ltd (including but not limited to the South African
Police Services, the South African Criminal Record Center, the
Government of the RSA, and any relevant educational, training and credit
organizations) for the purpose of verifying your personal credentials
and records.
2.
You furthermore authorize Transauto Recruitment cc and Kroll MIE
(Pty) Ltd’s verification information suppliers to furnish information
regarding your license, criminal, credit, professional and educational
history to Kroll MIE (Pty) Ltd and Transauto Recruitment cc. You
furthermore unconditionally indemnify Transauto Recruitment cc, Kroll
MIE (Pty) Ltd and its verification information suppliers against any
liability that may result from furnishing information in this regard.
3.
You understand that it is a condition of Kroll MIE (Pty) Ltd’s
verification information suppliers that this information is furnished by
them solely for the purposes of your proposed/continuation of employment
via the offices of Transauto Recruitment cc and that any information
that is furnished to Transauto Recruitment cc and Kroll MIE (Pty) Ltd
may be disclosed to you before a decision is made on your employment or
application for employment at Transauto Recruitment cc’s sole
discretion.
4.
You furthermore authorize Transauto Recruitment cc to supply any
prospective employer with the details of any such verification
information.
5.
You accept and agree that these terms and conditions govern the
relationship between you and Transauto Recruitment cc whether signed by
you, or electronically accepted by you, or tacitly accepted by you
through your action of attending an interview with a prospective
employer which Transauto Recruitment cc introduced you to.
APPLICANT Terms and Conditions of Use
1.
To the
fullest extent permitted by law, Transauto Recruitment cc (‘Transauto
Recruitment”) and its associates exclude all liability for any loss or
damage (including indirect, special or consequential loss or damage)
arising from the use of, or reliance on any services provided by
Transauto Recruitment or its associates. Transauto Recruitment and its
associates at all times limit their liability to the re-supply, where
possible, of services not properly rendered; and where the re-supply of
the service is not possible, to the refund of moneys paid for such
services. Transauto Recruitment will not be liable under this paragraph
where the failure to render services properly is attributable partially
or wholly to your actions or omissions.
2.
You
agree to keep Transauto Recruitment and its associates fully indemnified
against any actual or contingent liabilities incurred in relation to any
actions or claims brought by any person against Transauto Recruitment as
a result of an actual or alleged breach by you of any law, or such other
actions or claims brought in relation to the provision of services by
Transauto Recruitment to you.
3.
You
indemnify Transauto Recruitment against all claims, actions, suits,
liabilities, costs and expenses incurred on any account as a result of
the listing or intended listing of any curriculum vitae or other
personal information by you on
www.Transauto.co.za or any related website.
4.
Transauto Recruitment will make every effort to ensure that your
information is treated in the strictest confidence; however, you will
not hold Transauto Recruitment responsible if your curriculum vitae was
unlawfully copied from the Transauto Recruitment website through
nefarious means and/or distributed without consent.
5.
Only
Transauto Recruitment clients who have been approved for curriculum
vitae search capabilities and whom Transauto has issued with privileged
access codes to search the database have access to the Applicant
curriculum vitae database.
Such clients may access the Applicant curriculum vitae database for the
purpose of identifying applicants whose work preferences for location,
category, industry and occupation match the clients' current vacancy
advertisements with Transauto Recruitment.
While
Transauto Recruitment will make every effort to ensure that its clients
adhere to this undertaking, you herewith indemnify Transauto Recruitment
against wrongful conduct, of any kind, by Transauto Recruitment and/or
its’ clients.
6.
While
Transauto Recruitment will implement precautionary measures to ensure
that the Transauto Recruitment website is free from viruses, Transauto
Recruitment cannot and does not guarantee or warrant that files
available for downloading through the site or delivered via electronic
mail through the site will be free of infection or viruses, worms,
Trojan horses or other code that manifest contaminating or destructive
properties. You are responsible for implementing sufficient protective
software on your system that will satisfy your particular data security
requirements and for maintaining a means external to your workstation
for the reconstruction of any lost data.
7.
You
agree to take precautionary measures to ensure that your curriculum
vitae loaded on the Transauto Recruitment website is free from viruses
or other destructive code.
8.
Transauto Recruitment reserves the right to either reject or remove any
curriculam vitae from its site(s) for any reason whatsoever.
9.
You
agree to present yourself truthfully in your curriculum
vitaes
loaded
on the Transauto Recruitment website and database.
10.
Transauto Recruitment makes every effort to deliver applications for
vacancies in the shortest possible time. You will however not hold
Transauto Recruitment liable for any loss or damage as a result of any
failure or delay in the delivery of an application for employment to a
client or advertiser.
11.
You
agree, at all times, to deal with any information or products provided
by Transauto recruitment in a manner which abides by all applicable laws
of South Africa, or of any other relevant jurisdiction (including,
without limitation, privacy and copyright laws).
12.
You may
not assign or transfer your rights and obligations to any other person
without Transauto Recruitment’s prior written approval (which will not
be unreasonably withheld).
13.
This
agreement is governed by the laws of South Africa. You irrevocably and
unconditionally submit to the exclusive jurisdiction of the Courts of
South Africa, and waive any objection to legal action being brought in
those Courts on the grounds of venue or inconvenient forum.
14.
Transauto Recruitment retains all intellectual property rights contained
in the data stored on Transauto Recruitment’s website, systems and
services provided by Transauto Recruitment, and you agree not to
infringe any of Transauto Recruitment’s rights without Transauto
Recruitment’s prior written consent. This includes the use of public
domain information represented on Transauto Recruitment’s website.
15.
You
agree not to use the Transauto Recruitment website infrastructure or
technology to market any service to Transauto Recruitment.
16.
You
accept and agree that these terms and conditions govern the relationship
between you and Transauto Recruitment cc whether signed by you, or
electronically accepted by you, or tacitly accepted by you through your
action of attending an interview with a prospective employer which
Transauto Recruitment cc introduced you to.
